Purpose of this Policy
Discretion and the protection of your personal information is of the utmost importance to us, so we have prepared this policy to set out how we (Enlighten Talent Limited) will deal with your personal information. By providing your personal information to us, whether by applying for a position through us, engaging our services, or interreacting with our website or social media, you acknowledge the collection and use of such information by us, in accordance with this policy.

We primarily operate in New Zealand and Australia. However, due to the nature of our business, you may apply for a position through us or access our services, website or social media pages outside of New Zealand or Australia from elsewhere in the world. When dealing with your personal information, we will comply with this policy and with the New Zealand Privacy Act 2020 and the Australian Privacy Act 1988.

If you are not located in New Zealand or Australia, then this policy might not comply with the privacy regulations in your location. If you live elsewhere in the world and submit your personal information to us, you do so at your own risk knowing that you are providing us with personal information which we will deal with in accordance with the New Zealand Privacy Act 2020 and the Australian Privacy Act 1988.


1 . Personal Information

  • In this policy, personal information means “information about an identifiable individual” (as defined in the New Zealand Privacy Act 2020).

1.2 We collect, use, store, and disclose your personal information to provide you and employers that engage us with talent acquisition and recruitment services, to carry out our everyday business functions, to market ourselves and to meet our legal obligations.

2 . Personal Information Collected
2.1 We may collect the following personal information:

  1. Your name, date of birth, citizenship or residency and right to work in the relevant country;
  2. Your contact details such as your email address, postal address and mobile phone number;
  3. Photos of you and copies of your photo or non–photo ID;
  4. Your billing details (either for you to pay us or us to pay you);
  5. Your work history, credit history, criminal history, education and qualifications, personal and professional skills and attributes, testimonials and feedback, including your curriculum vitae and other documents that may contain further personal information;
  6. Testing results including skills, psychometric or cognitive testing;
  7. Details of references provided by you;
  8. Feedback about you from clients who you apply for a position with; and
  9. Website user data, collected when you visit our website. Website user data may include your IP address, cookies, device information, unique device identifiers, operating system and version and mobile network information.

2.2  Where possible, we collect personal information about you from you directly, when you provide that personal information to us, whether in person, phone, hard copy or electronic communications.

2.3  In some situations, we may indirectly collect your personal information (i.e. from a source other than yourself). This includes from:

  1. Third party individuals or organisations, where you have given us your permission i.e. when you give us permission to carry out a reference check, credit check, criminal history check, or to verify your educational credentials;
  2. Public sources of information including social media profiles;
  3. Other sources where you have authorised us to do so.

2.4  The third party individuals and organisations that we may indirectly collect personal information are:

  1. The references that you provide to us;

  4. The New Zealand or Australian Police (see: https://www.police.govt.nz/ or https://www.afp.gov.au/);
  5. Education providers in New Zealand or Australia, including tertiary and training institutions;
  6. Immigration New Zealand (see: https://www.immigration.govt.nz/);
  7. Inland Revenue (IRD) (see: https://www.ird.govt.nz/);
  8. Seek (see: https://www.seek.co.nz/);
  9. JobAdder (see: https://jobadder.com/); and
  10. From clients who engage Enlighten Talent to provide recruitment services that you are represented as a potential employee to.

2.5 Your rights to access and correct any personal information that is indirectly collected by us is set out in section 6 of this policy.

2.6  You can always choose to decline to provide your personal information to us, but this may affect us carrying out our general business functions or providing recruitment services.


3 . Use and disclosure:

3.1 We will only use personal information for the purposes for which it was obtained (and for directly related purposes), for other purposes with your express consent, or for other reasons permitted under the New Zealand Privacy Act 2020.


3.2 We do not share your personal information with others unless this is necessary for the purpose and directly related purposes for which we collected the information.


3.3 We need to use your personal information to carry out our services.

This may include:

  1. To provide you with talent acquisition and recruitment services and identifying what jobs you are interested in;
  2. Sending your details to prospective employers (e.g. CV, reference checks etc) with your permission for specific job applications;
  3. Carrying out reference and relevant probity checks and assessing your suitability for employment;
  4. Verifying your identity;
  5. Carrying out our everyday business functions, and marketing ourselves;
  6. Meeting our legal obligations.

3.4 Some of the people we may need to disclose your information to in order to carry out our services are:

  1. Our employees and contractors;
  2. Potential employers;
  3. References provided by you;
  4. A credit check agency, government agency or other organisations for the purpose of credit checking you, criminal history checks, conducting AML checks, or to ascertain your ability to work in New Zealand;
  5. Education or training providers to verify your qualifications or training;
  6. Psychometric or other testing providers

3.5 We may need to disclose information to some organisations in the course of our ordinary business activities, such as:

  1. Our business services providers, such as our billing software, cloud storage provider, IT providers, AI software providers, etc.
  2. Analysing non–identifiable web traffic data to improve our services;
  3. Our legal, accounting and business advisors; and
  4. Our debt collection agency.

3.6 Occasionally the law may require us to disclose it (for instance to investigate a criminal offence), or there may be safety reasons for disclosing it. We also analyse non–identifiable web traffic data to improve our services.


4 . Holding your Personal Information
4.1 We will ensure our employees and contractors take information security precautions and are also bound by an obligation of confidence to you.


4.2 We will hold your personal information for as long as it is needed for the purpose for which it was collected or for so long as we required by law to retain it.


4.3 We may retain your curriculum vitae and other application documents on file beyond your initial application for future roles and record keeping purposes. Should you wish for these documents to be deleted, please contact us at the details below.

5 . Communicating with you

5.1 We may use personal information for sending you information on the market or available opportunities in your sector, publications and invitations to events.


5.2 Where we communicate with you to market our services or for other marketing purposes, we will comply with the Unsolicited Electronic Messages Act 2007. This means that we will provide you with instructions for unsubscribing from such messages if you choose.


6 . Your Rights and Choices:
6.1 We take all reasonable steps to ensure that your personal information that we hold is accurate, up to date, complete, relevant and not misleading.

6.2 If you wish to request access to, or correction of, your personal information, please contact us on the details provided below.


6.3 You can ask to be removed from our mailing list at any time.
